Short Term Rental Agreement
This agreement is hereby made between Qiang (Frank) Fu, hereafter known as Owner, and ______________________________, hereafter known as Renter. Renter shall rent Owner’s premises at 2xxx Andros Ln, Kissimmee, FL 34747, USA
From ___________________ (date) 4:00 pm (check-in no sooner than 4pm)
To ___________________ (date) 10:00 am (check-out no later than 10am)
1. Rental Payments: The total rental payment for this Lease shall be $_____________ US Dollars. The payment is due in full 45 days prior to the check-in date (*). If the signed date of this agreement is within 45 days of the check-in date, the payment is due immediately. Cashier’s Check or Money Order is preferred. 4% service fee for Credit Card and PayPal payment. Renter must be responsible for all processing fees associated with payment. Any processing fee incurred by OWNER will be subtracted from the Security Deposit. Owner reserves the right to cancel the reservation if payment has not been received in accordance with above statement. A reservation cancelled by owner will follow the same Cancellation Policy as specified in this Rental Agreement. A payment notification email will be sent to remind the renter. Detailed Payment Instruction is attached below. *For monthly rental, please contact owner for the payment schedule.
2. Security Deposit: The security deposit shall be the sum of TWO HUNDRED US DOLLARS (US$200). The payment is due with the signed agreement. The premises shall be reserved under Renter’s name as soon as the deposit reaches Owner. Please note any reservation made orally without the security deposit paid shall not lock up the property. Within one week after checkout date, the deposit shall be sent back to Renter. In case the property has any damage that leads to repair, the deposit may not be fully returned.
3. Lawful Purposes: Renter agrees to use the premises exclusively for a private residence and in compliance with local municipal ordinances, board of fire underwriters’ rules and regulations, and for lawful purposes. In the event the premises are used at any time for unlawful purposes, Owner may declare this Lease null and void.
4. Late Check-out: In case Renter needs late check-out, Renter shall submit a request to Owner at least two days in advance. The request may not be granted if new renters will check in on the same day. If the request is granted, $30 will be charged for 1 hour late check-out, $50 for 2 hours late check-out.
5. Accommodation: The accommodation provided is only for the use of persons listed on the Property Booking Form. Subleasing, sharing or re-assigning is prohibited. If any changes in occupants occur Owner must be notified for insurance reasons.
6. Smoking: Smoking is NOT allowed inside the unit or in the pool/patio area. There will be additional cleaning charge of $150 if Renter chooses to ignore this condition of booking.
7. Animals and Pets: Animals and pets are NOT permitted in the home. This condition is strictly enforced. There will be additional cleaning charge of $150 if Renter chooses to ignore this condition of booking.
8. Cancellation: Renter may cancel the confirmed reservation any time. Cancellation must be in writing in the form of a letter or email. The following cancellation charges will apply:
· Over 90 days prior to the check-in date: deposit will be refunded minus $45 processing fee.
· 60 - 90 days prior to the check-in date: 50% deposit will be refunded. Alternatively, the 100% deposit can be used as credit towards future rental of the property within one year.
· 45 – 60 days prior to the check-in date: the deposit will not be refunded.
· 30 - 45 days prior to the check-in date: 50% rental payment will be refunded.
· Within 30 days prior to the check-in date: the deposit and all rental payment will not be refunded.
9. Liability for Property Damage: Owner shall not be liable for any loss or damage to personal property belonging to Renter, Renter’s family members, servants, employees or visitors regardless how such damage or loss may arise and whether such a property is contained in the leased premises, or any portion of the premises.
10. Liability for Personal Injury: Owner shall not be liable for any personal injuries sustained by Renter, Renter’s family members, servants, employees or visitors regardless how such injuries may occur. Owner shall not be liable for any financial loss due to such injuries.
11. Damage to Rental Property: In case the rental property does not return to its normal conditions, wear and tear from reasonable use excepted, based on the inspection report Owner shall supply Renter with an itemized list of charges, and Renter agrees to pay the cost of repair in full, not limited to the deposit amount.
12. Uncontrollable Changes: Owner reserves the right to cancel the booking because of uncontrollable or undeniable circumstances including but not limited to mandatory evacuation due to expected severe weather conditions. For such changes in booking, Owner shall refund all deposit and rental payment without any service fees.
13. Safety and Security: Due to State Fire Regulations under no circumstances may more than the maximum number of occupants indicated on the Property Booking Form be allowed. Children must be supervised at ALL TIME whilst in the pool area. Glass is NOT permitted in the pool area. Owner and the management company reserve the right to enter the premises for safety or security reasons.
14. Website information: All descriptions given on Owner’s website are made in good faith, but there shall be no liability for error or omissions.
Payment Instruction
Money Order or Cashier's Check is preferred. 4% PayPal service fee for PayPal and Credit Card payment. If the signed date of the agreement is within 14 days of the check-in date, immediately PayPal or Credit Card payment is required.
PLEASE NOTE, YOU MUST SEND US THE FULL RENTAL AMOUNT. DO NOT DEDUCT $200 DEPOSIT FROM THE PAYMENT. YOUR DEPOSIT WILL BE REFUNDED ONE WEEK AFTER CHECK-OUT DATE IF NO DAMAGES ARE FOUND IN THE PROPERTY.
